Mismatched Social Security Numbers: An Employer’s Dilemma

A federal district court judge from the Northern District of California ruled that the government cannot use mismatched Social Security data to root out illegal immigrants from the workforce, declaring that such enforcement actions would do 'irreparable harm to innocent workers and employers." Judge Breyer issued a preliminary injunction temporarily preventing the Department of Homeland Security from beginning a program to punish companies that do not clear up discrepancies between their workers' names and Social Security numbers within 90 days after receiving a letter from Social Security advising them of the discrepancy.

What does this mean for employers? What should they do if they are faced with an employee's name that does not match the Social Security Number? Employers have to tread lightly in California in summarily terminating employees because of discrepancies in Social Security numbers. Mismatched Social Security data could be evidence that someone is unauthorized to work, or it could also be caused by a typo or name change. If an Employer takes the position that an employee with a mismatched Social Security number is unauthorized to work and therefore should be terminated, the employer is looking for trouble.

First, the new Homeland Security provisions place a burden on employers to comply with a new 90-day time frame for resolving mismatches. The scope of the rule would have staggering effects on employers, prompting them to develop costly personnel systems and fire workers who may be legally employed, thus exposing them to liability for wrongful termination. The liability exposure for employers summarily terminating employees with mismatched numbers could be staggering.

    Finance MBA & Doctor of Conflict Analysis/Resolution Prospects for work?
    I am a soon to be graduate with my MBA in Finance. I will do my PhD, but I don’t want it to be in finance, but rather something that I can tie together with finance. I will be starting my Doctorate in Conflict Analysis and Resolution (DCAR) in May, 2010. I will be 23 at the time I start the PhD, and should be 26 or 27 by the time I get my Doctorate. With those two degrees, what do you think my prospects for a job are? I know that I can work at a bank (because of the MBA) and mediation, government, education or counseling because of the DCAR. Any one else know what I may be able to do with the combination of the above two degrees? Thanks guys!!!

    Meaning do you think healthcare is now about IT? or is it more so related to Healthcare marketing now that Hospitals are more corporate driven then public? Less informal these days.

    What is the professional job title for someone that…….?
    is good at mediation or conflict resolution or accelerated resolution. I guess it boils down to being a good problem solver, but what is the professional title for someone that gets paid to do it? Im not talking about a judge or someone from that field. I am looking to change career fields and I have found that I am pretty good at solving problems and resolving issues for people that are frustrated with trying to solve or resolve their own issues. Can someone help me resolve my own issue or point me in the right direction?

    What’s your take on mediation and ADR? is it the new legal way in handling things?
    Is there a future in this? It’s rarely new. Considering getting a Masters in Conflict Resolution. Sounds good but if anyone has some advice or input that would be great.

    It’s a fairly new specialty and segment in law. Many corporations I believe are opting to take this route rather than spend large and unnecessary amounts of money going through a time consuming litigation.

    I have a masters in conflict resolution. I adore the mediation process. It can be a bit difficult for a non-attorney mediator in a good-ol-boy club county where the lawyers hold the monopoly. But there are other avenues if you’re willing to work outside the courts. There are so many areas of specialty that you can go into. I am NOT in favor of corporate-owned mediators though. I think that if the corporation is paying the mediators bills through payroll, it disqualifies the mediator as a neutral third party and places the interest in favor of the corporation. But it’s done. I am also partial to mediation over arbitration. I like that in a mediation, both parties come to their own agreement, as opposed to a binding resolution imposed by an arbiter. I am also opposed to the typical lawyer’s form of mediation we call “shuttle diplomacy.” I favor a facilitative mediation where the parties are kept face-to-face at the table to develop their own agreement and deal with the relationship issues.

    Conflict Resolution in Joint Custody?
    In my opinon joint custody is a joke. If the divorced couple had good communication and could agree on things (like issues concerning the children) they would still be married or at least working through the problems. That said I am interested in hearing about how to resolve differences in agreement when it comes to the children of divorce. I am speaking specificaly to issues like medical care,school issues and the like. If the couple can not reach an agreement on an issue how would you resolve it without the expense of going back to court. I am wonderning about mediation and using the GAL as the arbitrator. Any comments are welcome.

    Do freelance work for businesses that are struggling. Say a business is not making it.

    Go into the business and tell them under contract if you get their business to improve say 30% or more. Then you get paid that 30% + but if it doesn’t you don’t get paid.

    You can do this part time even while in school.

    everything we do is based on costs and benefits. healthcare is a touchy issue but it really comes down to can we develop a drug foror give care to someone without causing us to not develop one or care for someone else OR divert resources to make the sick better without hurting those who are not sick.
    It is all about tradeoffs and anyone who says we can do what we are doing right now but help everyone and make it cheaper is dreaming.
    I don’t say it should not be done but it will cost everyone something

    Well, Canada is a HUGE country, so cost of living, rent, and real estate all change depending on where you decide to settle. The majority of larger cities all have Osprey Media online newspapers which offer rental adverts, job postings and will have links to directories for real-estate companies. I am not exactly sure what someone in your field does, so cannot answer your question about that. You will need to decide what part of the country you would like to live in, which province, and then narrow it down from there. Weather here differs from province to province, as well as services and just about everything else……………..If you provide more details, I could give a better answer. Sorry if this does not help in the least.
    *Toronto is an excellent place if you enjoy face-pace, and excitment. It is also a great place for looking for enployment. Its downfalls are crowding, high market prices for rentals and purchases, and high cost of living. It is one of the best examples of multiculturalism and diversity Canada has to offer. Toronto is not my kind of place, as I have children. I am from Niagara Falls, Ontario originally, but now live in North Bay Ontario, which is a nice sized city, but has many natural resources located within short distance.
